In a nutshell
We will treat you as we would wish to be treated.
We will be fair at all times.
Our prices will be competitive for the quality we offer.
Our price list is available to download from the website.
We will always strive for unsurpassable quality in everything we do.
You will never be subjected to any pressure forcing you to buy from us, you will, however, be shown
probably the best pictures ever taken of your family.
We do not offer special deals at the viewing appointment. We do however have packages available for purchase prior to the viewing appointment that offer enormous savings.
Any offers you decide to purchase as a result of our marketing campaigns please note that photo-sessions (shoots) need to be completed within 3 months of the date of purchase.
Offers may not be used in conjunction with any other discount or offer, and may only be used as described.
Only one offer may be used at any one time.
We respect all faiths and will accommodate any special requirements, please enquire before your shoot
(ex: female staff only from photo session to edit to viewing).

If your problem is unresolvable over the phone we will ask you to set out the problem in an email, we will then continue our correspondence with you via email.
Unfortunately we will only allow one reschedule of your shoot booking so please make sure you are all
available when making your booking.
If you have been lucky enough to have won a prize then please understand that if you do not turn up for
your booked shoot appointment and/or do not return to view your images this will invalidate your prize as will rescheduling your booked appointment.
Our rescheduling policy for paid shoots is the same as our cancellation policy it applies to any shoot appointments made at Nousha Photography, you may reschedule once as long as you give us 5 days notice, as above, any further reschedules will be subject to a £50 non refundable fee.
You may only take advantage of one photo session prize per annum, irrespective of which member of your
family has won. We do not allow the use of the value of your prize as currency to purchase alternatives.
There is no cash, credit or other alternative to the prize offered. The prizes are non-transferable and not for resale. You may downgrade your prize (size or number of framed images) but we will not compensate you for the resulting financial loss by choosing a lower value item, for example downgrading from a Medium sized frame to a small.
We ask all our customers to return to view the images from your shoot within one month of the shoot date, preferably with your partner, non attendance within the required time of one month will invalidate
whichever prize you may have won and your images may be deleted.
It is mutually agreed that the following terms and conditions form an integral part of this contract and
that no variation or modification of this contract shall be effective unless accepted by Nousha Photography Ltd. trading as Nousha Photography, in writing.
What to expect
Our specialism at Nousha is to present you with a study of your children in addition we always shoot family groups, people come to us because they like what we do, but coming to us just for a group picture is pointless and we won’t do it.
A family photo session is a maximum of 4 children with two parents, we can accommodate more people,
however an extended appointment will be required and would be charged at the current shoot fee.
The 1988 Copyright Act assigns the copyright to the Photographer, who has in turn assigned copyright to Nousha Photography Ltd. It is contrary to the Act to copy, publish, reproduce or store our images electronically, unless the express permission of Nousha Photography Ltd. has been sought and or purchased. If permission is granted, then transfer of the copyright commences only once payment for the copyright has been made in full.
We electronically tag and track our images.
The Client may not (either personally or via a third party)alter or add to or manipulate a picture by means of computer or any other technique or reproduce a picture in whole or in part as an element within, or as a montage with, another picture.
We never provide the RAW versions of our images.
Nousha Photography reserves the right for any photograph created during sessions to be displayed in the studio, portfolio, or in any other advertising directly associated with Nousha Photography Ltd, we will contact you for authorisation prior to any use for specific authorisation.
Every effort will be made to carry out the contract but its due performance is subject to alteration or cancellation by us owing to any cause beyond their control (eg acts of God, change in legislation, floods, fire, computer failure, etc). In the unlikely event of total photographic failure or cancellation of this contract by us, liability shall be limited to a full refund of all monies paid.
These Terms and Conditions shall be governed and construed in accordance with the Laws of England.
Nousha Photography Ltd. shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, our liability (if any) shall be limited to rectifying such defect.
Licence shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. Nousha Photography Ltd. judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.
Photographic presentation and materials
All photograph sizes are nominal. Nousha Photography will provide a pleasing colour or black and white balance but cannot guarantee exact colour matching.
In the case of part mono/part colour images, the colours used will be subject to the photographer’s artistic interpretation and will be deemed to be correct.
All photographs supplied by Nousha Photography Ltd. are produced to the highest standards using the best quality materials and latest processing techniques. However, all photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass or UV glass. Framed prints or prints should NOT be kept in areas where the atmosphere is subject to higher than normal humidity content.
Nousha Photography Ltd. cannot accept any responsibility for this gradual image deterioration.
Matching previous order frame mouldings: we will match your previous order exactly if possible, however, over time frame moulding suppliers stock, evolves and it may not be possible to match it precisely so we will get as close as possible to what you received in your previous order.
Are supplied on one memory stick, please ensure you backup your digital images to another hard drive or
preferably to a cloud storage service, like Google Drive, Box or similar.
Condition of goods
All products purchased are presumed to have been received in good condition unless the Client notifies Nousha Photography Ltd. in writing of any discrepancy or error within 7 days of receipt.

All services and/or goods are supplied at the current prices ruling at the time of supply.
Prices are subject to change without notice.
Current pricing will be honored for thirty days for sessions from the date that they are purchased.
Special promotional discounts or other offers cannot be combined.
Delivery of your order
We do not have the facility for collection of your order. We will arrange delivery of your order using approved art delivery couriers for larger items, you will be quoted a delivery cost when your order is ready, payment must be made prior to the delivery. Digital orders and up to two 'petit' frames can be shipped using a standard mail or courier service, we charge their standard rate plus packaging fee.

Nousha archive service (legacy)
Payments for the Nousha Archive Service are taken immediately and then monthly from the date of your
signed sales order form which was presented to you at your viewing appointment.
You supply us with your payment details, payments are then taken using the Braintree recurring payments service.
You may cancel your subscription to the Nousha Archive Service at any time in writing to
firstname.lastname@example.org should you cancel your subscription, your images will be removed from the server at the end of your current paid storage term and deleted. The Nousha Archive service is stored on Amazon Web Services.

This service is no longer offered
Storage of images
Your images are NOT kept after the viewing, our storage capacity is reserved for production of current
images from shoots only. Nousha Photography Ltd. offers no guarantees with regard to electronic storage of any digital images, though we practice strict daily backup routines we cannot be held responsible for the loss of images due to equipment failure or any other reason beyond our control.
Nousha storage service
Nousha AWS (Amazon Web Services) storage of images is offered as a service to customers that have purchased images at the viewing appointment. Your agreement with us mirrors that offered by AWS with specific reference to the manner in which your images will be stored, we act as agent for AWS and we do not receive remuneration from AWS.You may review the agreement here:https://aws.amazon.com/agreement/
On subscribing to this service you will be charged £3.00 per month, this amount will be debited from your nominated credit card every month. The first debit which will be the date you have signed up to the service. You may cancel at any time.
The responsibility for cancelling and updating your credit card details rests with you the customer.
Failed payments, we will write to you via email informing you of any failed payments asking that
you reinstate the subscription or cancel it. Non-payment will unfortunately result in the deletion
of your images.
All re-orders shall be treated as an extension of this contract. No responsibility for error will be accepted
unless orders are given in writing. Approved by email and or signed for.
Framed Prints and Digital Negative orders
All orders are bespoke, we will not refund, nor accept the return of or refusal to pay charges for any technically acceptable photograph supplied as a digital file, framed printed image or any other form of media.
No exception can be made as we cannot be held responsible for individual tastes or exceptions. Your signature on the order form and payment forms a contract between you and Nousha Photography Ltd. T/A Nousha Photography.
Cancelled paid photo sessions that fall within our minimum free cancellation policy will be charged at £50.00
If you do not like any of the images from a shoot you have paid for we will refund your shoot fee in full.
We maintain a strict cancellation policy. In the event of cancellation of a paid shoot, please provide a minimum of five days notice failing this period of notice a cancellation fee of £50.00 will be charged.
In the event of cancellation of a prize shoot, please provide a minimum of five days notice or you will
forfeit your prize.
Cancellations may only be made by telephone.
Retouching and artist finishing is available as an optional extra and the final output and finish of any
image that is re-touched will be at Nousha Photography Ltd. discretion.
Any further retouching required after those agreed at the viewing appointment will be charged for at our
current retouching rates. £100 per hour, any further retouching will be charged at a minimum of one hour.
We occasionally offer images for sale online, when you tick the acceptance of 'Terms an Conditions' box you are deemed to have accepted the following: Online orders and online sales may only be made and paid for online, the reduced fee is partly achievable by not having a viewing appointment and keeping the transactions online only.
Once payment has been made, this constitutes an offer by you to purchase the items detailed in the shopping cart (“the Order”) in accordance with these terms and conditions. You agree to make payment for the Order in accordance with the terms and conditions detailed below.
The Order shall be deemed to be accepted when payment has been completed at which point a contract
between us shall come into existence.
Payment for the Order shall be made online immediately by credit or debit card only.
All Orders are bespoke and as such no changes or refunds are possible once the Order is placed as work
begins on your Order immediately.
Images will be produced as shown on the confirmation emailed Order form unless otherwise stated in writing.
Please ensure your choices are correctly depicted in this confirmation order form.
Nousha Photography will prepare your images and retouch them to a high quality finish, any special retouching instructions must be emailed immediately on completion of your order to email@example.com.
If we do not hear from you we will go ahead with our standard high level of retouching.
Digital Negatives may be printed and distributed as you wish for your personal use only. They may not be used for commercial purposes, published or syndicated in any way without prior written agreement from Nousha Photography Ltd.
Your Order will be made available to download, only, the images are NOT supplied on a USB stick.
It is your responsibility to back them up securely.
Nousha Photography reserves the right to update and change the terms and conditions of our Nousha Photography gift cards at any time. This does not affect your legal rights. Use of your Nousha Photography gift card constitutes acceptance of our Terms and Conditions and we, therefore, recommend you read them carefully. Nousha Photography gift cards remain the property of Nousha Photography who maintains the right to cancel the card in situations where it is deemed necessary to do so.
The value of your Nousha Photography gift card can be redeemed at Nousha Photography or online at www.nousha.co.uk or www.nousha.shop The gift card balance cannot be exchanged for cash or redeemed against the purchase of another card.
You can Top-Up or perform a Balance enquiry at Nousha Photography by taking your card to the studio. You can perform Balance enquiries via our website, by logging into the Nousha shop.
Your Nousha Photography gift card is valid for a period of 12 months from the date of activation, after which any remaining balance will be removed and the card will become invalid and no longer available for use.
Lost/ Stolen/ Damaged
In cases where your Nousha Photography gift card is lost or stolen, Nousha Photography is unable to replace or reimburse the remaining balance on a card. Nousha Photography cannot be held responsible for any balance lost on a Nousha Photography gift card as a result of theft or fraud. All Nousha Photography gift cards have a unique number. Nousha Photography cannot be held responsible for any unauthorised use where the card number has become known to another party
Should your Nousha Photography gift card become damaged, Nousha Photography will be able to replace the card providing you still have the card in your possession and the necessary details can be obtained.
Using a Nousha Photography gift card
Customers may use their Nousha Photography gift card in any participating studio and or via our website. Should you choose to use your Nousha Photography gift card outside of the country it was purchased in, foreign exchange rates applicable on the date of the transaction will apply to any transactions performed. Please note any redemptions, balance enquiries, top-ups and balance transfers will be reflected in the currency applicable to the country you are using it in.
Crediting a Nousha Photography gift card
Return of product(s) purchased using a Nousha Photography gift card is prohibited as all products sold are bespoke.
If a refund is required the amount due will be credited to the original method of payment. In the event that you may have discarded your Nousha Photography, a new Card will be issued to you with the refund amount applied.
If a partial refund is made for any purchase using a Nousha Photography gift card and another method of payment, then any refund amount owing will be credited to the Nousha Photography gift card in the first instance.
If the total to be refunded is more than originally paid by Nousha Photography gift card, then any remaining refund balance will be refunded to the other method of payment used (debit/credit card or cash).
Offers relating to Gift Cards may not be used in conjunction with any other discount or offer, and may only be used as described.
Only one offer may be used at any one time.
Governing Law and jurisdiction
These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
